Abstract

Labor law is recognized as one of the most protected worldwide, although it is also one of the most vulnerable due to the social challenges related to the right to equality for all people, regardless of their condition. In Ecuador, although the Constitution recognizes this right, it establishes specific guidelines for entry and permanence in the public sector, requiring merit-based and competitive examinations as the main requirement to guarantee job stability. However, there are hiring modalities that do not provide this stability. This study analyzes how people with disabilities who enter without this process can obtain job stability by law, which generates tensions with the principle of equality. Under a qualitative, descriptive and explanatory approach, and using the legal hermeneutic method, the incidence of the forms of entry to the public service in relation to labor stability is evaluated
